Omny IQ Software Privacy Policy
Updated May 15, 2018 - contact Omny IQ for any questions
Welcome to Omny IQ. Your privacy is very important to Omny IQ. So we’ve developed a Privacy Policy that covers how our software collects, uses, discloses, transfers, and stores your information. It applies to our products and technology that may be provided with a third party device or service that you have. Please take a moment to familiarize yourself with our privacy practices and let us know if you have any questions.
WHO WE ARE AND WHAT WE DO
Omny IQ’s mission is to provide a flawless connected experience to users. Every local network may have a variety of unique characteristics that affects the performance of your connected device or application. It’s often difficult for individual devices to work well in a network environment when they don’t have access to certain information on what’s going on around them. Because your product or service provider or device manufacturer cares about delivering the best user experience to you, as part of that commitment they’ve included Omny IQ software in the product or service that you use.
Omny IQ makes it easier for the companies, that provide you broadband or communications services or that design and manufacture products that you use, to remotely troubleshoot and fix your device and potentially improve its performance by providing real-time information to them regarding what’s happening within your device as well as the conditions of the local area network environment that it’s living in.
PERSONAL DATA YOU PROVIDE TO US AT OUR SITE
We collect Personal Data from you, such as first and last name, phone number, zip code, e-mail, professional title, company name, and password, when you purchase Products, register to receive information, register to activate an Omny IQ service, email us, or post a comment on our blog. In addition, we (or our third-party credit card or payment processor on our behalf) will collect Personal Data including your credit card number or account information when you purchase Products or services on our website. We also retain information on your behalf, such as the Personal Data described above and any correspondence or blog comments. If you provide us feedback or contact us via e-mail (e.g., a support enquiry or in response to an employment opportunity posted on our website), we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply, and any information that you submit to us, such as a resume. When you participate in one of our surveys, we may collect additional profile information such as your name, phone number, address, and e-mail address. When you post comments on our blog, the information contained in your posting will be stored on our servers and other users will be able to see it. To request removal of your personal information from our blog or community forum, contact us at support@omnyiq.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. We also collect other types of Personal Data that you provide to us voluntarily, such as operating system and version, information about your application and operating environment, and other requested information if you contact us via e-mail regarding support for the Products). We may also collect Personal Data at other points in our website that state that Personal Data is being collected.
OUR SOFTWARE DOES NOT COLLECT *IDENTIFIED* PERSONAL INFORMATION
Personal information, as defined by the EU General Data Protection Regulation (EU GDPR.org) means, “any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.” We consider *Identified* Personal Information to include user name, street address, phone number, banking information, or email address that can identify a person directly or indirectly. Omny IQ software does not collect your Identified Personal Information associated with the device or any other device running on the local network.
It gets a bit confusing for *Identifiable* Personal Information. A person may be identifiable through direct or indirect means. The more indirect the identifiers, the more it may depend on surrounding circumstances to determine whether the information qualify as protected personal information. Omny IQ software collects IP address and Mac addresses of the device that is running our software as well as the IP and Mac addresses of other devices connecting to this first device. However, we are not correlating this information to identify a person. For instance, we expect the increasingly popular adoption of in-store Wi-Fi tracking technology to be deemed as identifiable. Here, retailers use Wi-Fi scanners to “listen” to shoppers’ smartphones as they walk in and around the store, and collect data on variables such as device type, MAC address, whether the same device has been to the store before or not (repeat shopper vs. new), in which section of the store does the shopper spend more time, how many more people come in after a major TV ad campaign, etc. None of this data by itself explicitly identifies an individual, but in combination should qualify as personal data processing. Nevertheless, Omny IQ software does not collect IP and Mac addresses from user devices to combine them for such applications. Our purpose for the data we collect is for the purpose of improving the physical connected experience of users.
WE DO NOT TRACK YOUR WEB SURFING
We don’t track or report on any specific web surfing statistics such as the web sites you visit, social networks you participate in, products you purchase, or the games that you enjoy. We don’t collect that because we don’t sell it to advertisers or anyone else.
THE TYPE OF NON-PERSONAL INFORMATION THAT OUR SOFTWARE COLLECTS
WHAT WE DO WITH THE INFORMATION
WE SHARE INFORMATION WITH OUR BUSINESS PARTNERS
Omny IQ provides Non-Personal Information to third party companies that work with us in our business. Omny IQ’s Privacy Policy does not cover the actions of third parties (except service providers acting solely on behalf of Omny IQ), and Omny IQ cannot control how such third parties may collect, use or secure your data. For information about a third party's privacy practices, please consult the privacy policy of that third party.
HOW SECURE IS THE INFORMATION?
We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information. We also use additional industry standard security measures including but limited to firewalls. The Internet is not 100% secure, but we do our best to make sure that the information we collect is protected.
WE STORE INFORMATION IN AND OUTSIDE THE UNITED STATES
If you live outside the United States, you understand and agree that we may transfer your information to the United States or our offices in other countries. Our sites are subject to U.S. laws, which may not provide the same level of protection as those in your country.

However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, popular browsers allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

- In order to do that, we may collect certain information from your connected devices in real time and in the live conditions that it is running in.
- This software is specifically designed to provide certain, anonymized data to Omny IQ that we can then collect, analyze, and provide information to the manufacturer or provider of this device.
- The intent of the data collection and analysis is to provide you with a better-connected experience by helping the device manufacturer or service provider to better understand what is happening with your device and the live network conditions surrounding it.
- That information may allow the manufacturer or service provider to identify and correct certain problems for you even before you know they exist.
- Omny IQ also enables your service provider or device manufacturer to remotely update your device.

THE TYPE OF NON-PERSONAL INFORMATION THAT OUR SOFTWARE COLLECTS
- Omny IQ software regularly and automatically collects data in a form that does not, on its own, permit direct association with any specific individual. We consider this “Non‑Personal Information” or Anonymous Information.
- Omny IQ software collects data about other devices on the local network when they are connected to the device that our software is running.
- The collected information includes, for example, the IP address and MAC address associated with your device, your device type and model, other device identifiers, various quality measures, error logs, hardware and software version numbers, Wi-Fi network strength, and certain demographics such the country and city where the device is connected.
- We also collect data such as CPU and memory utilization and other device and network usage statistics.
- Any or all of this information may be used by the device manufacturer to better identify and understand things such as device performance issues, non-current firmware, network congestion, wireless signal quality issues, frequent device disconnections, or potential network conflicts that they may use to improve the reliability or performance of the connected device.
- Omny IQ may collect, use, transfer, and disclose Non‑Personal Information for any purpose.
WHAT WE DO WITH THE INFORMATION
- The information is securely uploaded to our cloud-based servers, where certain analysis is applied.
- We then give access to that information to the product or service provider or device manufacturer so that they may make decisions or take action as they determine. For example, the information may help the device manufacturer to better identify and fix issues associated with potential problems such as excessive device reboots, crashes, or local network conflicts.
- In some instances, anonymized, Non-Personal information about the device used in the context of the specific, local network may be shared with other Omny IQ-enabled third-party device manufacturers and chipset companies, that have devices present on your local network or use certain IC chips from one or more of these companies, to better help your devices work together to potentially identify and solve problems. An example of this may be when an Omny IQ-enabled streaming entertainment device on your network is experiencing excessive buffering of a video. That device may request certain information (that it otherwise wouldn’t have access to) from other Omny IQ-enabled devices on the local network to help it identify the performance issue. In this example, it may request information regarding the WIFI router signal strength or channel conflicts from an Omny IQ-enabled WIFI router, which may help the streaming entertainment device manufacturer better troubleshoot and fix the issue.
- Finally, we may also share aggregated, Non-Personal, anonymized or statistical information about you, including demographics data, with others for a variety of purposes, including for the device manufacturer’s or service provider’s own uses, for example, for improving their products and services for you, Omny IQ and others.
DISCLOSURE
- We will disclose Information as required by law, or if in our judgment it is necessary to respond to lawful governmental requests or legal process (for example, a court order, search warrant, or subpoena); the information is relevant to a crime that has been or is being committed; an emergency exists that poses a threat to your safety or the safety of another person; or it is necessary to protect the rights or property of Omny IQ or our employees.
- If the ownership of Omny IQ or an affiliate or their assets changes as a result of a merger, acquisition, sale of assets, or in the unlikely event of a bankruptcy, your information may be transferred to another company. If we believe a transfer results in a material change in the use of the Information we've collected or received about you, you will be given the opportunity to opt out of the transfer.
